This Privacy Policy explains how Strucwise Inc. ("Strucwise", "we", "us" or "our") collects, uses, discloses, retains and protects personal information when you access or use our websites, web application, platform, APIs, trials, subscriptions, support channels, communications and related services (collectively, the "Services").
Strucwise provides software and AI-enabled tools for structural engineering workflows, including structural analysis assistance, design checks, draft drawing generation, reporting, automation and related technical services. This Privacy Policy applies to personal information. Some information processed through the Services, such as building geometry, structural model parameters, drawings, calculations, project metadata and technical inputs, may not identify an individual. When such information identifies, relates to, or could reasonably be linked to an identifiable individual, we treat it as personal information under this Privacy Policy.
Privacy summary
Key points: We use personal information to provide, secure, support, bill for and improve the Services. The Services may use AI and machine learning to process customer inputs and generate outputs. We may use de-identified, anonymized and/or aggregated Customer Data to train, test, validate and improve Strucwise models, algorithms and software. We do not use payment information, customer names, project names, personal signatures, professional seals, or direct personal identifiers for model training. We do not sell personal information or Customer Data.
1. Scope and relationship to customer agreements
This Privacy Policy should be read together with Strucwise's Terms of Service, End User License Agreement, Service Level Agreement and any applicable commercial agreement, order form, data processing agreement or other written agreement between Strucwise and a customer.
For account, website, billing, sales, marketing and support information, Strucwise generally acts as the organization responsible for determining how and why that personal information is processed. For Customer Data submitted to the Services by or on behalf of a business customer, Strucwise generally processes that data to provide the Services to that customer, subject to the applicable agreement.
If there is a conflict between this Privacy Policy and a written commercial agreement signed by Strucwise and a customer, the signed commercial agreement will govern to the extent of the conflict.
2. Information we collect
We may collect the following categories of information:
· Account and business contact information. Name, business email address, company name, job title, phone number, mailing address, username, password or authentication information, account preferences and related profile information.
· Billing and transaction information. Subscription plan, billing address, tax information, invoices, payment status, transaction records and payment method information. Payment card details may be processed by our payment service providers; we do not need to store complete payment card numbers.
· Customer Data submitted to the Services. Project files, design inputs, assumptions, load information, material properties, analysis models, drawings, CAD/BIM files, calculation reports, prompts, instructions, outputs, comments, project metadata, customer standards, templates and other technical information submitted to or generated through the Services. Customer Data may include personal information if, for example, drawings, title blocks, stamps, seals, signatures, addresses, names, emails or project documents identify individuals.
· Usage, device and technical information. IP address, browser type, operating system, device identifiers, pages and features used, session activity, timestamps, log files, API usage, performance metrics, error reports, security logs and similar technical data.
· Communications and support information. Emails, chat messages, support tickets, meeting notes, call recordings or transcripts where applicable, survey responses, product feedback and other communications with us.
· Cookies and similar technologies. Information collected through cookies, local storage, pixels, analytics tools and similar technologies, as described in Section 11.
· Information from third parties. Information from business customers, authorized users, referral sources, integration partners, payment processors, identity/authentication providers, analytics providers, publicly available sources, and other third parties where permitted by law.
3. How we use information
We may use personal information and Customer Data for the following purposes:
· to create, administer, authenticate and secure accounts;
· to provide, operate, maintain, monitor and improve the Services;
· to process customer inputs, generate outputs, provide analysis assistance, draft drawings, reports, calculations, design checks and other requested results;
· to manage trials, subscriptions, billing, invoices, payment processing, renewals and customer accounts;
· to provide customer support, troubleshooting, onboarding, training, notices and administrative communications;
· to monitor usage limits, service capacity, system performance, reliability and availability;
· to detect, investigate and prevent fraud, abuse, security incidents, unauthorized access and violations of our agreements or policies;
· to develop, test, train, validate and improve software, AI models, algorithms, workflows, templates, product features and user experience as described in Section 4;
· to comply with legal, regulatory, tax, accounting, security, dispute resolution and contract obligations;
· to send marketing communications where permitted by law and in accordance with your preferences; and
· for any other purpose with notice to you or with your consent, where required.
4. AI, machine learning and use of de-identified, anonymized and aggregated data
AI-enabled Services. The Services may use artificial intelligence, machine learning, optimization algorithms, automation rules and related technologies to process Customer Data and generate outputs. Outputs may include analysis models, draft drawings, draft reports, design-assistance information, calculations, recommendations, checks, classifications or other technical results.
Use of Customer Data to provide the Services. We use Customer Data, including project inputs and generated outputs, to provide the Services requested by the customer, operate the platform, troubleshoot issues, maintain security, support users, enforce usage limits and comply with customer agreements.
Model training and product improvement. We may use Customer Data in de-identified, anonymized and/or aggregated form to develop, train, test, validate, evaluate and improve Strucwise software, AI models, machine-learning systems, algorithms, automation workflows, analysis methods, product features, quality assurance processes and benchmarks. This may include using generalized technical patterns, structural parameters, geometry relationships, usage metrics, error information, performance signals, quality feedback, output validation results and similar information that does not identify a customer, project, user or individual.
What we do not use for model training. We do not use payment card information, account passwords, customer names, user names, personal email addresses, project names, project addresses, personal signatures, professional seals, stamps or other direct personal identifiers to train models. Where Customer Data contains direct identifiers, we use reasonable measures to remove, mask, aggregate or otherwise reduce identifiability before using it for generalized model training or product-improvement datasets.
No re-identification. We do not attempt to re-identify data that we have anonymized, aggregated or de-identified for training, analytics or product-improvement purposes, and we use reasonable safeguards designed to reduce the risk of re-identification.
Third-party AI and infrastructure providers. We may use third-party cloud, infrastructure, analytics, security, hosting or AI service providers to help provide and improve the Services. Where such providers process Customer Data on our behalf, we use reasonable contractual, technical and organizational measures designed to require them to process the data for Strucwise purposes and not for their own independent purposes, unless we disclose otherwise or obtain any required authorization.
Customer-specific restrictions. A customer may have additional restrictions or commitments in a signed commercial agreement, order form, data processing agreement or similar document. Those written commitments will apply to the extent they conflict with this Privacy Policy. Customers who require restrictions on use of their Customer Data for product improvement or AI training should address those restrictions in their written agreement with Strucwise.
5. Consent and legal bases for processing
We collect, use and disclose personal information with consent where required by law. Consent may be express or implied, depending on the context and sensitivity of the information. By creating an account, submitting information to the Services, using the Services, communicating with us, or entering into an agreement with us, you consent to the collection, use and disclosure of personal information as described in this Privacy Policy and the applicable agreement.
We may also process personal information where necessary to perform a contract, provide the Services, comply with legal obligations, protect security and legal rights, prevent fraud or abuse, or for other purposes permitted by applicable law. You may withdraw consent where consent is the basis for processing, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may limit or prevent our ability to provide certain Services.
6. How we disclose information
We may disclose personal information and Customer Data as follows:
· Service providers and subprocessors. To vendors and contractors that help us provide, secure and operate the Services, such as cloud hosting, database infrastructure, authentication, payment processing, email delivery, customer support, analytics, logging, monitoring, security, AI infrastructure, professional services, legal and accounting providers.
· Business customers and account administrators. If your account is associated with a customer organization, that organization and its administrators may access information about your account, usage, support requests and Customer Data associated with that organization.
· Authorized integrations and third-party services. Where you or your organization connect, enable or authorize integrations or third-party services, we may disclose information as needed to provide that integration or as directed by you or your organization.
· Legal, safety and compliance purposes. Where required or permitted by law, court order, subpoena, regulatory request, legal process, tax or accounting requirement, or where we believe disclosure is necessary to protect rights, safety, security, property, users, customers, Strucwise or others.
· Business transactions. In connection with a merger, acquisition, financing, reorganization, sale of assets, due diligence, insolvency, bankruptcy or similar corporate transaction, subject to appropriate confidentiality protections where applicable.
· With consent or direction. Where you, your organization, or another authorized party instructs us to disclose information or gives consent to the disclosure.
We do not sell personal information or Customer Data. We do not disclose Customer Data to data brokers. If we use advertising or analytics technologies that are considered a "sale" or "sharing" under applicable privacy law, we will provide any notices and choices required by that law.
7. Cross-border processing and storage
Strucwise is based in Canada. We and our service providers may process and store personal information and Customer Data in Canada, the United States and other jurisdictions where we or our service providers operate. Information processed in another jurisdiction may be subject to that jurisdiction's laws and may be accessible to courts, law enforcement, regulators or government authorities in accordance with lawful process.
Where required, we use contractual, technical and organizational measures designed to protect information transferred across borders.
8. Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, to provide the Services, comply with legal and accounting obligations, resolve disputes, enforce agreements, maintain security, or as otherwise permitted or required by law.
Customer Data may be retained for the term of the applicable subscription or agreement and for a reasonable period after termination to support backups, account recovery, dispute resolution, legal compliance, audit, security and business continuity. Unless a signed agreement provides otherwise, Strucwise may retain Customer Data for up to thirty-six (36) months after termination or expiry of the applicable Services, after which it may be deleted, anonymized or retained only as permitted by law or the applicable agreement.
De-identified, anonymized or aggregated information that does not identify an individual, customer or project may be retained and used for analytics, benchmarking, model training, product improvement and other lawful business purposes.
9. Security
We use reasonable administrative, technical and physical safeguards designed to protect personal information and Customer Data against unauthorized access, loss, misuse, alteration, disclosure or destruction. These safeguards may include access controls, authentication controls, encryption or similar protections where appropriate, logging, monitoring, backup controls, employee confidentiality obligations, vendor review and incident-response procedures.
No system, network, transmission or storage method is completely secure. Customers and users are responsible for maintaining the confidentiality of their credentials, using secure networks and devices, managing user access within their organizations, and promptly notifying us of any suspected unauthorized access or security incident involving the Services.
10. Your privacy rights and choices
Depending on where you live and the laws that apply, you may have rights to request access to, correction of, deletion of, or information about our collection, use and disclosure of your personal information. You may also have the right to withdraw consent, object to certain processing, restrict certain processing, request portability, or file a complaint with a privacy regulator.

If your personal information is contained in Customer Data controlled by a Strucwise business customer, we may direct your request to that customer or respond in accordance with that customer's instructions and applicable law.
